A brief overview of the conveyancing process.

Conveyancing is the legal term for the process that transfers the legal title of a property from one party to another.

There are some companies that simply specialise in conveyancing but at this present moment in time most of our clients feel happier using a local solicitor to take care of the conveyancing side.

Solicitors have had many years of training and often solicitor firms have designated members of staff who deal solely in conveyancing.

The steps taken during a typical property transaction.

  1. You are thinking of selling.
  2. You choose your agent.
  3. You take independent mortgage advice.
  4. The agent finds you a buyer.
  5. Your mortgage broker instructs a survey on your purchase.

Once this is all done you appoint a solicitor to do those crucial checks in finalising your purchase.

So what does a conveyancer actually do?

A conveyancer’s job is to legally check that you are buying something which is re-saleable. Imagine if you did not use a solicitor and when you come to resell your property your buyers found that you were only allowed to live in that property for six months of the year. It sounds silly but many properties can have restrictions and therefore it is a conveyancers job to check the following;

  1. That the person you are buying from legally owns the property.
  2. That there are no hidden debts to the property.
  3. That any alterations such as loft conversions, extensions, change of use for example have the necessary planning permissions or consents required.

These are just a few of the many important issues. The legal process is very complex and that is why we leave it to the experts and so should you. Choose a solicitor who has a solid understanding of conveyancing and can offer you a wealth of practical experience as well as competitive rates.
